Terms of Use

Effective October 28, 2026

These terms apply to ObituaryUS (www.obituaryus.org) and the other free websites run by Kempster Berger Inc. ("we", "us"):

  • FuneralUS (www.funeralus.com)
  • ProbateUS (www.probateus.com)
  • VeteranFunerals (veteranfunerals.org)
  • Cheap Funeral (www.cheap-funeral.com)
  • FunerariaCerca (www.funerariacerca.com)
  • DeathUS (www.deathus.com)
  • HospiceCompare (www.hospicecompare.org)
  • ObituaryUS (www.obituaryus.org)

By using the sites you agree to these terms. If you don't agree, please don't use them. Our Privacy Policy explains how we handle your information.

A free service

The sites are free. Most are directories and guides with no accounts. ObituaryUS lets you create an account with your email address to write, publish and manage obituaries, also for free: there are no fees, subscriptions or paid upgrades. We are not a funeral home, cemetery, crematory, court, law firm, insurer, financial adviser or government agency, and we don't sell funeral, legal or financial services.

Not professional advice

Everything on the sites is general information. It is not legal, financial, tax, medical or funeral-planning advice for your situation, and using the sites does not create an attorney-client or any other professional relationship.

Probate, estate and benefits rules differ by state and change over time. Calculators and checklists give estimates based on the rules we cite; they can be wrong or incomplete for your case. Before you act, check with the court, the agency involved or a licensed attorney or other professional.

Listings and prices

We build our listings of funeral homes, cemeteries, courts, hospices and other providers from public sources, government data and providers' own websites. Details such as prices, hours, phone numbers, services and fees can be out of date or wrong. Always confirm with the provider or court before you rely on them. A funeral home's current General Price List is the only binding price.

A listing is not an endorsement. We don't check licenses or the quality of anyone's services. Ratings and review counts shown on some pages come from third parties, and we don't control them.

If something about your business or court is wrong, email info@funeralus.com and we'll correct it.

No government affiliation

The sites are independent. VeteranFunerals is not a U.S. government site and is not affiliated with or endorsed by the Department of Veterans Affairs or any military branch. ProbateUS is not a court and is not affiliated with any court. FunerariaCerca is not affiliated with any consulate or government. For official decisions and forms, contact the agency, court or consulate directly.

We pay for the sites through our own estate-settlement service and business relationships, not by charging visitors. EverSettled (eversettled.com) is that service: Kempster Berger Inc. runs it as well as these sites. Links and messages promoting EverSettled are our own advertising, they are labeled as sponsored, and we benefit when you use EverSettled. Providers can pay for an upgraded listing, such as extra profile details or a badge. Neither changes the facts we report about a provider.

Requests you send through the sites

When you use a form to ask for help, we will try to answer, but we don't promise a response time or that a provider will be available or offer a particular price. Any agreement you make for funeral, legal, insurance or other services is between you and that provider. We are not a party to it and are not responsible for the provider's services.

ObituaryUS accounts

  • You sign in with a code we email you. Keep access to that email account; anyone who can read it can sign in as you.
  • Each obituary has one owner: the email address that created or claimed it. You must be at least 18 to create one.
  • Only create an obituary for someone who has died, and only if you are family, are acting for the family, or have their agreement.

Your obituary is yours

You keep the rights to what you write and upload. You give us a limited, non-exclusive, royalty-free license to host, store, format, display and share it (including share images, QR codes and printable programs made from it) only to run ObituaryUS and only for as long as it is on the site. The license ends when you delete the content, except for copies kept for a short time in backups or as required by law. We do not sell, syndicate or license your obituary to anyone, and we do not use it to advertise.

Please only upload text and photos you have the right to use. An obituary written by a funeral home or a newspaper may belong to them; ask before you copy it word for word.

What may be published

On obituary pages and condolences, please don't publish:

  • an obituary for a living person, a hoax, or anything meant to deceive;
  • hate speech, harassment, threats, or private details of other people that put them at risk;
  • links, phone numbers or email addresses in condolences, or advertising and fundraising appeals other than the obituary's one donation link;
  • content that infringes someone else's copyright, privacy or other rights.

We check text automatically for hate speech, strong language in condolences, links and spam, and may refuse to publish it. We may hide or remove content, or suspend an account, that breaks these rules.

Condolences

Condolences belong to the people who write them, who give us and the obituary's owner the same limited license to show them on that page. The owner decides which condolences appear, can hide any of them, and can turn condolences off. We may remove a condolence that breaks these rules. To have your own condolence removed, ask the owner or email us.

Reports, takedowns and family disputes

  • Every obituary has a "Report a problem" link, including "this person is alive." We review every report. While we review, the page normally stays up; we take it down at once when a report is credible and serious, such as a living person.
  • Families sometimes disagree about an obituary. If you are close family or the executor and object to a page, email info@funeralus.com with the page address, your relationship and what you object to. We will contact the owner, and may ask both sides for more information. We may correct, hide, transfer or remove a page when that is the fair outcome. We cannot settle legal disputes between relatives.
  • Copyright complaints: send the page address, the work you own and a statement that you believe the use is not authorized to info@funeralus.com. We remove infringing material promptly.
  • If your ObituaryUS obituary is copied onto another site without your permission, tell us and we will help you ask that site to take it down.

Keeping pages up

We intend to keep published obituaries online without charge and at the same address, and to forward old addresses when a name or date is corrected. If we ever had to close ObituaryUS, we would give owners notice and a way to download their obituaries first.

Other websites

The sites link to websites we don't control, including EverSettled, providers and government agencies. We are not responsible for their content, products or privacy practices.

Using the sites

Please don't:

  • use the sites for anything unlawful or to harass anyone;
  • submit false information, or someone else's details without their permission;
  • try to break, overload or get around the security of the sites;
  • copy the sites' content in bulk or scrape them in a way that burdens our servers.

Our content

The text, design and compilations on the sites belong to us or the people who license them to us. You may read, print and share pages for your own non-commercial use. Public-domain government data stays public domain.

Disclaimer

The sites and everything on them are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement. We don't promise that the sites will always be available or free of errors.

Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your reliance on information on the sites or from a provider's services. Because the sites are free, our total liability for any claim relating to them is limited to US$100. Some states don't allow these limits, so they may not all apply to you.

Indemnity

If you misuse the sites or break these terms and a claim is brought against us because of it, you agree to cover our reasonable costs of that claim.

Governing law

These terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute will be decided by the state or federal courts located in Delaware, unless the law of your home state requires otherwise.

Changes to these terms

We may update these terms. The date at the top shows when they last changed. Using the sites after a change means you accept the new terms.
